1. Who we are

BallGoBounce ("we", "us") is a service operated by ALOISIO FORMENTO JUNIOR TECNOLOGIA DA INFORMACAO LTDA, CNPJ 62.585.774/0001-89, São Paulo, Brazil. Contact: [email protected]. By using BallGoBounce at ballgobounce.com you agree to these terms.

2. The service

BallGoBounce is a web app that creates bouncing-ball videos. The videos are rendered on your own computer, in your browser. We may improve, change or add features over time.

3. Plans

• Free: 3 modes (Classic, Grow, Bricks), unlimited exports with the BallGoBounce watermark, and your own bounce and interaction sound uploads.
• Creator: a paid subscription that removes the watermark (or replaces it with your own text), unlocks the Creator-only modes and new modes we release, and includes a commercial license for the videos you export.

4. Payments and subscriptions

• Payments are processed by Creem, which acts as the merchant of record and reseller of your purchase. Creem's terms also apply to the payment, and Creem handles applicable sales tax and VAT.
• Creator is billed upfront for 1, 6 or 12 months and renews automatically for the same period until you cancel.
• You can cancel anytime with "Manage or cancel subscription" in the app, or at creem.io/my-orders with your purchase email. Your plan stays active until the end of the period you paid for.
• Founding member price: if you subscribe at a price marked as a founding price, we won't raise the price of your subscription while it stays active without interruption.
• Refunds follow our Refund Policy.

5. License keys

After you buy Creator you receive a license key. One license can be active on up to 3 browsers or devices at the same time; you can remove it from a browser in the app to free a slot. Your license is personal: don't share or resell it. During the first 7 days after purchase, Creator exports are counted by our license server to apply the refund policy.

6. Your videos and your content

• You own the videos you export. On Creator you may use them commercially, including on monetized channels and for clients.
• Videos made on the Free plan must keep the BallGoBounce watermark.
• You are responsible for everything you upload or add, such as images, music, sounds and text. Only use material you have the rights to, and follow the acceptable use rules (no sexually explicit or NSFW content). Platforms like TikTok and YouTube may mute or remove videos with copyrighted music.
• Your uploaded files stay in your browser and are never sent to us.

7. Acceptable use

These rules apply to every video you make with BallGoBounce and to everything you add to it: images, sounds, music, text and watermarks. You may not use BallGoBounce to create or share content that:

• is sexually explicit, pornographic or otherwise NSFW, including nudity, sexual acts and sexualized images or text;
• sexualizes, exploits or endangers minors in any way;
• is hateful or harassing: attacks, threatens, bullies or demeans a person or a group (for example because of race, ethnicity, nationality, religion, gender, sexual orientation or disability);
• promotes or glorifies violence, terrorism or self-harm, or shows graphic gore;
• is illegal or promotes illegal activity, such as the sale of drugs or weapons;
• infringes someone else's copyright, trademark, privacy or other rights, or impersonates a person or brand;
• is deceptive, such as scams, fraud, fake giveaways or spam.

Also don't try to bypass plan limits or license checks, copy or resell the BallGoBounce app, overload our servers, or use the service to break the law or the rules of the platforms where you post.

We may suspend or terminate a license that is used in breach of these rules. To report content made with BallGoBounce that breaks them, write to [email protected].

8. Availability and warranty

We work to keep BallGoBounce running and useful, but it is provided "as is". We don't guarantee that it will be uninterrupted or error-free, that it works with every browser or device (we support current Chrome and Edge on desktop), or that your videos will reach any number of views or earnings.

9. Liability

To the extent allowed by law, our total liability for any claim related to BallGoBounce is limited to the amount you paid us in the 12 months before the claim. We aren't liable for indirect losses such as lost profits, lost data or lost views. Nothing in these terms limits rights that consumer protection laws give you and that can't be waived.

10. Changes

We may update these terms. If a change materially affects paying customers, we'll announce it on this page at least 14 days before it takes effect. If you don't agree, you can cancel before then.

11. Law

These terms are governed by the laws of Brazil, with the courts of São Paulo, SP, as the forum, without prejudice to the mandatory consumer protection rules of the country where you live.
